1. Acceptance of Terms
By downloading or using Kept ("the app"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app. Kept is provided by Simena Digital LLC ("we," "us," or "our"), a Wyoming limited liability company.
2. About Kept
Kept is a personal trading journal. You log trades by typing or saying a sentence, check the card the app fills in, and review your month on a calendar. The app compares the plan you stated when you opened a trade with the exit you stated when you closed it and reports the difference.
Kept is a personal record-keeping tool. It does not execute trades, hold funds, or give investment advice. Leveraged products carry a high risk of rapid loss. Figures are your own entries.
Every statistic, stamp and calendar cell in the app is computed from the numbers you entered and describes your own logged trades. Nothing in the app is a recommendation to buy, sell or hold any instrument, and you are solely responsible for your trading decisions.
3. Account
Kept uses Sign in with Apple. Your account carries your sign-in, subscription state, AI consent and technical usage records. You are responsible for keeping your Apple ID secure. You may delete your account at any time from Profile; deletion becomes permanent after a 30-day grace period.
4. Subscription & Payments
Kept Pro is offered as an auto-renewable weekly or annual subscription billed through your Apple Account. The applicable price, billing period and any eligible introductory or discounted offer are displayed in your local currency before you confirm a purchase.
Eligible new subscribers may receive a discounted first week on the weekly plan; it then renews at the regular weekly price shown at purchase. Annual plans have no introductory period. An eligible discounted annual plan renews at the annual price shown at purchase, subject to Apple’s rules for price changes. Offers and prices can vary by storefront and eligibility.
Payment is charged to your Apple Account at confirmation. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before that period ends. Manage or cancel in iOS Settings → your name → Subscriptions, or Apple’s subscription settings. Deleting the app or your Kept account does not cancel a subscription. Refund requests are handled by Apple under its terms and applicable law.
5. Your Content and Export
Your trades, notes and transcripts are yours. They are stored on your device and in your own iCloud Drive; we hold no copy. You may export everything you logged as CSV or PDF at any time, including after your subscription lapses. New trade capture and AI extraction require an active subscription.
6. AI Extraction
If you enable AI trade extraction, the text of a note you submit is processed by our provider, OpenAI, to fill in the trade card. Extraction is optional, can be declined or disabled at any time, and the app remains fully usable without it. Extracted values are labelled as AI output and must be checked by you before saving; we make no warranty that an extraction is correct.
Transcripts are produced by Apple’s on-device speech-recognition engine and may contain errors, omissions or misheard words. Verify anything you plan to rely on against the original recording. You are responsible for complying with laws about recording other people’s speech. Apple, RevenueCat, OpenAI and Sentry provide services described in our Privacy Policy; their applicable terms govern those interactions.
7. Acceptable Use
You agree not to reverse-engineer the app, interfere with our servers, circumvent the subscription, or use the extraction service for anything other than your own trade notes. We apply an abuse cap on extraction requests per account.
8. Intellectual Property
The app, its design and its software are owned by Simena Digital LLC and licensed to you under Apple’s standard End User License Agreement for a personal, non-transferable use.
9. Disclaimer and Limitation of Liability
The app is provided "AS IS". To the fullest extent permitted by law we disclaim all warranties and are not liable for any trading loss, lost profit, or indirect damage arising from your use of the app, including from an incorrect extraction, a mis-stated figure, or a lost or corrupted record. Our total liability is limited to the amount you paid us in the twelve months before the claim.
10. Termination
You may stop using the app and delete your account at any time. We may suspend accounts that violate these Terms. Your right to export what you logged survives termination.
11. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules. Mandatory consumer-protection law in your country of residence is not affected.
12. Changes
We may update these Terms; the date above reflects the current version. Continued use after a change constitutes acceptance.
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
